Operators of free bus services in England have been paid Bus Service Operators Grant (BSOG) unlawfully, the DfT has admitted. The Department has written to operators saying that payments of the fuel duty rebate for free services will cease from next April. Under the Transport Act 1985 free services are not a local service and therefore don’t meet the criteria of the BSOG (England) Regulations 2002.
