The DfT has published advice for developers, local authorities and residents on the procedures for local authorities adopting roads so that they become maintainable at public expense. Agreements under Section 38 of the 1980 Highways Act are the most common method of achieving road adoption, and are typically used when roads are planned for new residential and commercial developments.
